The Supreme Court (SC) has stayed the High Court (HC) order till October 31 that declared mobile courts under executive magistrates as unconstitutional.
As a result, there is no bar to lead mobile courts by the executive magistrates during the period.
A five-member bench of the Appellate Division headed by the Acting Chief Justice Md Abdul Wahhab Miah passed the order following a petition seeking time filed by the state on Tuesday.
Barrister Hassan SM Azim moved for the writ petition while Attorney General Mahbubey Alam and Deputy Attorney General Motahar Hossain Saju represented the state in the court.
Earlier on May 11, the High Court declared unconstitutional the rules under which executive magistrates run mobile courts.
